Family Violence - So what ? Is this the correct approach in a Family Law property matter ?
Increasingly, family violence is raised in application for parenting and property matters in the Family Court (Federal Circuit Court). But so what ? If there is family violence in a property matter what issue does it go to ? The case of Kenan is specific in what effect the Family Violence is required to be evidence of and in the case of any future needs arguement that relies upon evidence in a jurisdiction where evidence applies. It is increasingly the case that family violence is raised as what I call the "ooh aar !" factor. That is it merely causes a moment of interest without substance (in a legal sense).
