Binding Financial Agreements - Do they really work ?
Sounds great, right ? Avoiding Court and "sorting the property out" quickly and cheaply ! Well, increasingly, these documents are being churned out without full and frank disclosure; inadequate or even no real advice as to benefits and dissadvantages; poor property descriptions and inequitable outcomes which are future time bombs for litigation to overtuns such "binding" financial agreements. One wanders which such a poor standard of agreements being rushed through like conveyancing mills, whether Consent Orders of the Court might be a better, and potentially cheaper approach when parties can agree.
